Terms of Service

1. The agreement
These Terms of Service govern your access to and use of NextSequence (the “Service”), a software platform that drafts, quality-checks, schedules, and sends personalized follow-up email and SMS sequences for sales leads. By creating an account or using the Service you agree to these terms. If you are using the Service on behalf of an organization, you agree on its behalf.
2. License, not sale
The Service is licensed to you, not sold. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own legitimate sales follow-up. We retain all rights, title, and interest in the Service, its software, design, and underlying models and prompts. You may not copy, resell, sublicense, reverse-engineer, or create derivative works of the Service, or access it to build a competing product.
3. Who owns what
Your data stays yours. The leads, call transcripts, contacts, and message content you bring to or generate in the Service remain your property. You grant us only the limited license needed to operate the Service for you: to store, process, and transmit that data to produce and send your sequences.
The system stays ours. The application, its generation and quality-control logic, templates, and any improvements remain ours. Aggregated, de-identified operational metrics used to keep the Service reliable are not your confidential data.
4. Your responsibilities for messaging
You are the sender of every email and text the Service transmits on your behalf, and you are responsible for compliance with the laws that apply to that sending, including CAN-SPAM and the Telephone Consumer Protection Act (TCPA). You represent that:
- you have a lawful basis and, where required, prior express consent to contact each recipient;
- your messages identify you accurately and are not deceptive;
- you honor opt-out requests promptly, and you will not remove or defeat the unsubscribe and STOP handling the Service provides;
- you will not use the Service to send unlawful, harassing, or misleading content.
The Service enforces quiet hours, spaced cadence, consent checks, and opt-out handling as safeguards, but you remain responsible for how you use it.
5. Acceptable use
Do not misuse the Service: no attempts to break, overload, or gain unauthorized access to it; no using it to violate anyone’s rights; no sharing your account credentials. We may suspend access that threatens the Service or other users.
6. Third-party services
The Service connects, at your direction, to third-party providers such as your email and CRM systems and your call-recording and messaging providers. Your use of those providers is governed by their own terms, and you are responsible for the accounts and keys you connect.
7. No warranty; limitation of liability
The Service is provided “as is” without warranties of any kind. We do not guarantee any particular deliverability, response, or sales outcome. To the maximum extent permitted by law, our aggregate liability arising from the Service is limited to the amount you paid for it in the three months before the claim.
8. Termination
You may stop using the Service at any time. We may suspend or end access for breach of these terms or to protect the Service. On termination, your license ends; you may request an export of your data within a reasonable window.
